General Conditions of Sale
Article 1 - Purpose

These conditions govern any sales contract entered into by the single-member simplified joint-stock company with capital of 10,000 euros, registered at the RDC of Compiègne under number: xxx and whose head office is located at 13 Chemin de Catillon, 60410 Rhuis relating to any order for items and gift cards sold on the e-commerce site www.mondeenmains.com

Article 2 - Price
The prices of our products are indicated in euros, all taxes included (VAT and other taxes applicable on the day of the order), unless otherwise indicated and excluding processing and shipping costs.
If you are ordering from a country other than mainland France, you are the importer of the product(s) in question. Customs duties or other local taxes, import duties, or state taxes may be payable. These duties and amounts are not the responsibility of SASU Monde en mains. They will be your responsibility and are your sole responsibility, both in terms of declarations and payments to the relevant authorities and organizations in your country. We advise you to inquire about these matters with your local authorities.
All orders, regardless of their origin, are payable in euros.
SASU Monde en mains reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price in effect at the time of validation of the order and subject to availability.
Some images may be rendered in 3D. These are non-binding presentation suggestions.
The products remain the property of SASU Monde en mains until full payment of the price.
Please note: as soon as you take physical possession of the products ordered, the risks of loss or damage to the products are transferred to you.

The contractual information is presented in French and will be confirmed at the latest at the time of validation of your order.
The company SASU Monde en mains reserves the right not to record a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of a difficulty concerning the order received.
Placing orders on the Site is subject to the creation by the Customer of a personal account (hereinafter the "Account") during which the Customer must provide personal information, such as his/her name, first name and email address. The Customer must ensure the validity of the email address provided and check the filtering rules of his/her email in order to prevent emails from "Monde en mains" from being considered as SPAM.
All information communicated by the Client to “Monde en mains” must be accurate, complete, and up to date. The management of the Account and personal information is done on the Site.
The Client undertakes to read and accept the confidentiality policy of “Monde en mains” accessible on the Site concerning the processing of personal data: xxx.
When creating his Account, the Customer chooses a password to identify him and to allow a faster connection during his future uses of the Site. The Customer agrees to choose a personal and confidential password. To guarantee the security of his Account, the Customer agrees to:
not to disclose the password to third parties;
take the necessary precautions to prevent third parties from having access to it;
take measures to prevent a third party from accessing the Account, even without the Client's knowledge;
not give access to his Account to a third party (the loan, sharing, exchange, gift, purchase, transfer and sale of Accounts are prohibited and not enforceable against “Monde en mains);
not to use a third party’s Account;
use a personal email address and do not share this email address;
allow Monde en mains to contact the Customer via their email address.
The Customer assumes responsibility for maintaining the confidentiality of his password, as well as for its use. The Customer is solely responsible for the use of his Account. Any connection or transmission of data made using his password will be deemed to have been made by the Customer and under his responsibility.
In the event of fraudulent use of his Account and/or password, or in the event of loss or theft of his password, the Customer must immediately inform “Monde en mains”.
If the Customer forgets his password, he can report it by clicking on the "Forgotten password" section. He will then receive an email at the email address provided in his Account indicating a new password.
The security of the Account is the sole responsibility of the Customer and “Monde en mains” cannot be held responsible for any damage that may be suffered by his Account or his computer following the loss or sharing of his Account identifiers and passwords.
The Customer is responsible for and presumed to be the author of the purchases made on or via his Account.
Cookies:
A cookie is a file containing data transmitted by the server of a website to the browser of the client using the site. The cookie is stored on the client's hard drive.
This file allows "Monde en mains" to recognize its customers each time they connect and to display the status of their shopping cart. If the customer deletes the cookie created during their first connection to the site, identification is no longer possible and the customer can no longer view the contents of their shopping cart.
Article 4 - Validation of your order
Any order placed on the website www.mondeenmains.com implies acceptance of these General Conditions. Any order confirmation implies your full acceptance of these general conditions of sale, without exception or reservation.
All data provided and the recorded confirmation will constitute proof of the transaction.
You declare that you are fully aware of this.
The order confirmation will be worth signature and acceptance of the operations carried out.
A summary of your order information and these General Conditions will be sent to you in PDF format via the email address confirming your order.
Article 5 - Payment
Le fait de valider votre commande implique pour vous l'obligation de payer le prix indiqué.
Le règlement de vos achats s'effectue par carte bancaire grâce au système sécurisé Revolut / Alma
Le paiement est effectué en euros exclusivement, en totalité à la commande, pour les livraisons à domicile et retraits en showroom, au choix par carte bancaire, virement bancaire, Paypal ou en carte cadeau.
Les commandes ne sont prises en compte qu'après validation de leur règlement. Aussi, aucun escompte ou pénalité de retard n'est applicable. Les paiements ne peuvent être suspendus ou faire l’objet d’une compensation sans accord écrit et préalable de « Monde en mains ».

Paiement par carte bancaire
Sont acceptées les cartes bancaires suivantes : Carte bleue, Visa et Mastercard.
Dans le cadre de son action en faveur de la lutte contre les fraudes sur internet, « Monde en mains » peut être amenée à vérifier les coordonnées bancaires et/ou l'identité des Clients avant toute livraison. En passant sa commande sur le Site, le Client s'engage à fournir à « Monde en mains » les justificatifs d’identité qui pourront lui être demandés. A défaut de communication des éléments sollicités dans le délai imparti, « Monde en mains » se réserve le droit d'annuler ladite commande.

Paiement par virement bancaire
Tout paiement par virement bancaire s’effectue en totalité à la commande. Le RIB de « Monde en mains » sera communiqué au client sur la page de confirmation de la commande ainsi que par mail.
Le client devra indiquer le numéro de commande dans le libellé de son virement.
En cas de défaut de réception du virement bancaire dans un délai de trois (3) jours ouvrés à compter de la confirmation de la commande par le Client, la commande sera considérée comme annulée.

Paiement par PayPal
Lors de la validation de sa commande, le Client doit entrer son adresse e-mail liée à PayPal ainsi que son mot de passe Paypal. Si le Client ne dispose préalablement pas de compte PayPal, il sera, au moment du paiement, dirigé vers une page PayPal de création de compte lui permettant de bénéficier de ce mode de paiement.
Le Client pourra utiliser la fonctionnalité PayPal Express lui permettant de passer commande directement par son compte Paypal sans création de compte « Monde en mains ».

Paiement en plusieurs fois : Paiement Paypal en 3 fois sans frais
Lors de la validation de sa commande, le Client doit entrer son adresse e-mail liée à PayPal ainsi que son mot de passe Paypal. Si le Client ne dispose préalablement pas de compte PayPal, il sera, au moment du paiement, dirigé vers une page PayPal de création de compte lui permettant de bénéficier de ce mode de paiement.
Le Client pourra utiliser la fonctionnalité PayPal Express lui permettant de passer commande directement par son compte Paypal sans création de compte « Monde en mains ».
Le paiement en 3 fois sans frais, est accessible sur le web pour les commandes comprises entre quatre-vingt-dix Euros (90€) et huit mille Euros (8 000€).
Au moment du paiement, le Client est redirigé vers le serveur de Paypal afin de finaliser son paiement en 3 fois et obtenir le détail de ses mensualités. Le Client sera alors invité préalablement à l’exécution du paiement à prendre connaissance et accepter les CGU et la politique de confidentialité de Paypal. Paypal est gestionnaire de télé-paiement et délivre un certificat électronique qui vaudra preuve du montant et de la date de la transaction conformément aux dispositions des articles 1364 et suivants du code civil.

Paiement par carte cadeau
La carte cadeau « Monde en mains » est pour une durée de douze (12) mois à partir de sa date d'activation. La date d’activation correspond à la date d’achat et ne peut faire l'objet ni d'un échange, ni d'un remboursement, ni d'un rendu monnaie, pour quelque motif que ce soit.
L’utilisation partielle d’une carte cadeau est acceptée, le solde pouvant être consulté directement sur le Site. Dans le cas d'un règlement partiel de la commande par carte cadeau, le Client devra payer le solde par carte bancaire.
Le cumul de cartes cadeaux est accepté dans la limite de cinq (5) cartes et trois mille Euros (3000€) d’achat.

Facturation
La facture adressée au Client reprend les indications renseignées par ce dernier dans son Compte. Les indications renseignées ne pourront faire l’objet d’une quelconque modification postérieurement à l’émission de la facture. Le client est seul responsable de la validité des informations renseignées dans son compte.
Article 6 - Withdrawal
In accordance with the provisions of Article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from receipt of your products to exercise your right of withdrawal without having to provide reasons or pay a penalty.
Returns must be made in their original condition and complete (packaging, accessories, instructions). In this case, you are liable. Any damage to the product in this case may invalidate your right of withdrawal.
Return costs are the responsibility of the customer.
In the event that the right of withdrawal is exercised, “Monde en mains” will reimburse the sums paid, within 14 days following notification of your request and via the same means of payment as that used when ordering.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL:
In accordance with the provisions of Article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to:
The provision of services fully performed before the end of the withdrawal period and the performance of which began after the consumer's express prior agreement and express waiver of his right of withdrawal.
The supply of goods or services whose price depends on fluctuations in the financial market beyond the control of the professional and which may occur during the withdrawal period.
The supply of goods made to the consumer's specifications or clearly personalized.
The supply of goods liable to deteriorate or expire rapidly.
The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.
The supply of goods which, after being delivered and by their nature, are inseparably mixed with other items;
The supply of alcoholic beverages whose delivery is deferred beyond thirty days and whose value agreed upon at the conclusion of the contract depends on fluctuations in the market beyond the control of the professional.
The supply of audio or video recordings or computer software where they have been unsealed by the consumer after delivery.
The supply of a newspaper, periodical or magazine, except for subscription contracts to such publications.
Transactions concluded at a public auction.
The supply of digital content not supplied on a tangible medium, the execution of which has begun after the consumer's express prior agreement and express waiver of his right of withdrawal.
Article 7- Availability
To combat overproduction, we encourage made-to-order production as much as possible. Our products are available while they are visible on the website www.mondeenmains.com and within the limits of available stocks or for pre-order. If our products are not in stock, the customer can pre-order them.
Furthermore, the website www.mondeenmains.com is not intended to sell its products in large quantities. Consequently, the company "Monde en mains" reserves the right to refuse orders if the number exceeds the production capacity of its partners.
Article 8 - Delivery
The products are delivered to the delivery address indicated during the order process, within the time indicated on the order validation page.
In the event of a shipping delay, an email will be sent to you to inform you of any possible impact on the delivery time indicated to you.
In accordance with legal provisions, in the event of a delay in delivery, you have the option to cancel the order under the terms and conditions defined in Article L 138-2 of the Consumer Code. If you receive the product in the meantime, we will refund it and cover the shipping costs under the conditions of Article L 138-3 of the Consumer Code.
In the event of deliveries by a carrier, the company “Monde en mains” cannot be held responsible for late delivery due exclusively to the unavailability of the customer after several proposed appointments.
Article 9 - Warranty
All our products benefit from the legal guarantee of conformity and the guarantee of hidden defects, provided for by articles 1641 and following of the Civil Code. In the event of non-conformity of a product sold, it may be returned, exchanged or refunded.
All complaints, requests for exchange or refund must be made by email to contact@mondeenmains.com or via the contact form on the website www.mondeenmains.com within 30 days of delivery.
The products must be returned to us in the condition in which you received them with all the elements (accessories, packaging, instructions, etc.). The shipping costs will be refunded to you on the basis of the invoiced rate and the return costs will be refunded to you upon presentation of supporting documents.
The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.
Article 10 - Liability
The products offered comply with current French legislation. The company "Monde en mains" cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with the local authorities the possibilities of importing or using the products or services you plan to order.
Furthermore, the company “Monde en mains” cannot be held responsible for damage resulting from improper use of the product purchased.
Finally, the company "Monde en mains" cannot be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, an external intrusion or the presence of a computer virus.
Article 11 - Applicable law in the event of disputes
The language of this contract is French. These terms and conditions of sale are subject to French law. In the event of a dispute, the French courts will have sole jurisdiction.
Article 12 - Intellectual property
All elements of the site www.mondeenmains.com are and remain the intellectual and exclusive property of the company "Monde en mains". No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or audio. Any simple or hypertext link is strictly prohibited without the express written consent of the company "Monde en mains".
Article 13 - Personal data
The company "Monde en mains" reserves the right to collect personal information and data about you. This information is necessary to manage your order, as well as to improve the services and information we send you.
They may also be transmitted to companies that contribute to these relationships, such as those responsible for the execution of services and orders for their management, execution, processing and payment.
This information and data is also retained for security purposes, in order to comply with legal and regulatory obligations.
In accordance with the law of January 6, 1978, you have the right to access, rectify and oppose personal information and data concerning you, directly on the website.
Article 14 - Archiving Evidence
The company “Monde en mains” will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.
The computerized records of the company "Monde en mains" will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
